Dear New Homeowner:
The Meadows at Cherry Hills Homeowners’ Association would like to extend a warm welcome to you. We are excited to have you as our newest member of the homeowners’ association. Please join fellow members in activities and events that are held by the association throughout the year.
We will mostly communicate with you by email so please take a moment to complete and return the contact information sheet.
We will also send you a notice by email and postal mail about our annual meeting that takes place in the spring. At the meeting you will receive an update from the trustees about the HOA and vote on open board position(s) and subdivision topics.
Annual subdivision dues are communicated by mail and handled by the “City and Village Tax Office”. Do not disregard any mail from “City and Village” as it will contain important information.

Indenture of Trust and Restrictions
We want to take this opportunity to introduce you to the Indenture of Trust and Restrictions for our subdivision. This document spells out important covenants and restrictions which are for the purpose of protecting the value and desirability of your property and the subdivision.
Be reminded that the indentures are a legally binding contract that you the homeowner and all parties having any right, title, or interest with the property, including lessees, must abide by. These indentures are recorded with St. Louis County.
Please take time to understand the indentures and ensure the occupants of your home also have an understanding.
We would like to highlight some of the indentures that come up from time to time to help you prevent any future violations. This is not an exhaustive list and we encourage you to review the full copy of the indentures to be aware of all of them.

Any new building, fences, walls, driveways, or other structure or improvements require plans and specifications to be submitted to and approved by association directors. (Section 8a)

No commercial activity of any kind shall be conducted. (Section 10a.ii)

No noxious or offensive activity that may be or become a nuisance or annoyance to the neighborhood. (Section 10a.iii)

Each owner shall maintain and keep the lot in good order and repair. (Section 10a.iv)

No above-ground swimming pools are allowed. No in-ground swimming pools are allowed without the prior written approval of the directors. (Section 10a.viii)

Fences require approval and must meet standard and requirements. (Section 10a.ix)

Overnight street parking is prohibited. (Section 10a.xiv)

City of Wildwood law Section 365.080 prohibits parking on any public road in excess of 24 hours, except in an emergency or between 5:00 PM Friday and 9:00 AM Monday. Enforcement is by the City of Wildwood Police Department.​

Trash/recycling containers cannot be stored in the front or side of the house. Containers can be placed out for collection starting the evening before collection day and stored away by sundown of the same day. (Section 10a.xv)

City of Wildwood law Section 230.070 requires that containers shall be stored in a place not visible from the street which the residential structure faces. Residential solid waste containers shall be placed at the curb or street frontage, except as otherwise required by the Director for collection. Solid waste containers and bundles of tree waste permitted by this Chapter shall be placed at the curb or street frontage, not more than twelve (12) hours prior to the regularly scheduled collection day. Waste containers shall be returned to their appropriate storage places no later than 12:00 Midnight on the day of collection. Enforcement is by the City of Wildwood Code Enforcement Officer.​

It is important to note that the indentures grant the Meadows at Cherry Hills Homeowners’ Association the right to enforce all of the covenants, conditions, restrictions and provisions. If the association must engage legal counsel against you, the indentures state that you are responsible for attorneys’ fees and costs incurred with or without legal action and failure to pay these costs will result in a lien placed on your property. (Section 11b).
Your cooperation by ensuring compliance with the indentures is appreciated by the association and your neighbors, and will help maintain an aesthetically pleasing community.
